These questions can be answered by looking at history. Sergei Shilov, owner of AT Consulting - one of the largest domestic IT companies. In the early 2000s, Shilov worked at Accenture, which he left in order to build his own business from scratch. In 2009, just after then-President Medvedev’s words about the openness of the state, AT Consulting began creating an e-government infrastructure. It was this company that developed the government services portal, federal and regional systems of interdepartmental electronic interaction in 2011-2013 (SMEV) and several subsystems in the same area. Since then, Sergei Shilov’s company has accumulated hundreds of successful projects in federal and regional authorities, major banks and telecom operators. Thus, in preparation for the Universiade in Kazan, AT Consulting developed an electronic document management and ERP system at Rostelecom. However, today all this can be considered only an intermediate result of the work of Sergei Shilov, who not only believed in modernization, but also invested his labor in it.

The real result of many years of work in this area was the recent decision of the Basmanny Court of Moscow, which took Shilov into custody. This happened precisely on the day when the president’s new address to the Federal Assembly contained words about “digitalization” and ending pressure from the security forces on business. A man who, not in words but in deeds, participated in the modernization of key state-owned companies is today in a pre-trial detention center. Will there be other businessmen in the country who want to follow his path?

Why was he detained?

This story began with the fact that in October 2017 he was detained and taken into custody Andrey Nechaev, acting head of the FKU NPO "StiS" of the Ministry of Internal Affairs of Russia. Three years earlier, Nechaev ordered software development from JSC Scientific Research Institute of Automatic Equipment named after Academician V.S. Semenikhin. We are talking about a unified system of information and analytical support for activities (ISOD) Ministry of Internal Affairs of the Russian Federation. AT Consulting was a subcontractor on this project. The system was made, the customer accepted the work, but three years after that, law enforcement agencies began to have complaints about the project - they say that the system is “crude” and needs to be improved. At that time, ISOD was introduced for use in the Ministry of Internal Affairs; hundreds of thousands of department employees used it. This did not stop the security forces from accusing Andrei Nechaev of accepting an unfinished system from a contractor, and Sergei Shilov– that he allegedly convinced the customer to accept work that was not fully completed.

There are more and more strange things in the case. According to Sergei Starovoitov, who is the lawyer of Sergei Shilov, the investigation was unable to document to the court its arguments regarding the detainee, although it was obliged to do so. The defense attorney states that the security forces did not provide a single piece of evidence or a single reference to documents that would confirm his client’s criminal intentions. The lawyer also noted that, contrary to the law, the investigator in his petition does not propose any measures other than detention. Sergei Shilov is accused of aiding and abetting an official to exceed his authority, and this charge cannot imply the maximum penalty of 10 years in prison, which is voiced by the investigation.

The criminal case in which Sergei Shilov is accused was officially opened on February 27, 2018. However, the latest witness statements that the investigator added to the case materials are dated February 13 of this year. Shilov himself, whom investigators summoned for questioning a week later, was not asked a single question on the merits of the charges.

The search that took place on February 27 raises even more questions. During this event, Sergei Shilov, who at that time was in the status of a witness, was forcibly brought to the Investigative Committee. The search itself was carried out on the basis of a court order adopted on February 20, 2018. What happened in the depths of the Investigative Committee that two weeks after the interrogation of witnesses and a week after the interrogation of Shilov himself, a criminal case was opened, the defendant of which was urgently taken to a pre-trial detention center? Apparently, Sergei Shilov changed his status from witness to accused right on the way to the detention center.

Lawyer Sergei Starovoitov considers it obvious that there was a violation of the law during the detention of his client. The defense lawyer notes that Shilov was detained during the search, and in the middle of the night he was taken to the RF Investigative Committee without any documents. At the same time, the head of AT Consulting was still in the status of a witness. During the interrogation to which he was subjected on February 21, the investigator did not ask a single question on the points on the basis of which Sergei Shilov was charged.

Pre-trial detention center instead of house arrest

According to the decision of the Plenum of the Supreme Court, law enforcement agencies must pay great attention to the choice of preventive measures in cases involving entrepreneurs, and in general in cases related to economic activity. Business rights ombudsmen have repeatedly pointed out that businessmen should be deprived of their freedom only in exceptional cases. Despite this, Sergey Shilov ended up in custody. When considering the investigation's request to select a preventive measure, the court ignored the reference from Shilov's place of work, which indicates the extreme undesirability of excluding him from the process of managing the company. The same circumstance is indicated by the petition filed by the deputy head of Rosreestr Andrey Pridankin, who told the court about an extremely complex project to implement a new information system for a unified state register of real estate objects (EGRON), in which AT Consulting participates.

However, the investigation considered that Sergei Shilov’s presence of a foreign passport is sufficient reason to fear his escape from the country. At the court hearing, where the investigation's request for a preventive measure was considered, lawyer Sergei Starovoitov pointed out that during the investigation his client repeatedly traveled outside the Russian Federation and voluntarily returned back. It’s easy to check – just look at the marks in his passport. According to the lawyer, this indicates that Shilov does not intend to hide from court. In addition, the defense lawyer noted that during the interrogation on February 21, the investigation did not notify the head of AT Consulting about the need to limit travel abroad; until February 21, the Investigative Committee employees did not take any action at all to restrict the freedom of Sergei Shilov.

Sergei Starovoitov recalled that, according to Russian law, the presence of a foreign passport is not evidence of the criminal intentions of its owner. In addition, Shilov’s international passport was not seized either during the interrogation on February 21, or during the search and detention that followed. The lawyer believes that the investigation filed a petition to place Sergei Shilov in custody for two months for the purpose of moral and psychological pressure.

When choosing a preventive measure for Sergei Shilov, the court considered the arguments of the investigation, which were that the accused had a foreign passport; the presence of a large number of subordinates on whom he could allegedly put pressure, and the testimony of witnesses, who, however, nowhere pointed to Shilov as a person who had committed any crime. The court rejected the arguments of the defense, which petitioned for a more lenient measure of restraint and pointed to the pregnancy of the wife of the director of AT Consulting, the presence of four minor children, the petition of the deputy head of Rosreestr, and the gratitude of Sergei Shilov from the Minister of Internal Affairs of the Russian Federation and the heads of large government organizations from all over the country. .

What is ISOD?

    On December 19, 2017, investigative measures took place in the capital offices of AT Consulting on Bolshaya Novodmitrovskaya and 2nd Khutorskaya streets, a company employee told TAdviser and was confirmed by a second source with reference to his familiar AT Consulting employees.

    In November-December 2015, AT Consulting (one of the main legal entities of the AT Consulting group) implemented an information system for the MFC of the Republic of Crimea.     One of the top managers and co-owners of the company, Dmitry Potapov, has been appointed acting general director of AT Consulting. He worked in the company's management for more than 12 years, headed the ERP practice and was a managing partner.

    To solve the problems of import substitution, AT Consulting implements projects based on its own products developed on the basis of open source software. In 20 regions of the Russian Federation, its own AT Consulting SMART platform has been deployed, designed to automate government services and functions.
